Constellations, Wormholes, and Black Holes of Litigation

Travel through a lawsuit arising from a student’s assault and see the issues you need to overcome to resolve the matter. On the trip, we will see constellations of collaboration dedicated to responding and resolving the problem(s), wormholes that shorten the journey or make it easier, and invisible black holes that can trap and harm the travelers.

This workshop will benefit individuals using enterprise risk management and others from institutions either with no inside legal counsel or with a close working relationship with the campus general counsel. It will also benefit individuals who work directly with student affairs conduct/disciplinary staff or campus security. Individuals from both public and private institutions will benefit from this workshop.

As a result of participating in this session, attendees will:
 Understand the legal framework of sometimes conflicting statutes, regulations, court and OCR decisions surrounding physical assault including Title IX, VAWA, Clery/SaVE, torts and general due process principles.
 Understand the litigation process, the differing roles of campus and external legal counsel, and the role for risk management.
 Analyze the early decisions that influence the success of the litigation, availability of insurance coverage, and cost involved.
 Examine the e-Discovery processes and determine when to retain an outside vendor.
 Implement a structure for controlling internal and external communication about the litigation.
 Collect ideas and strategies to prevent similar litigation in the future.
